Terms of Service
1 Agreement
By downloading, installing, or using the Pocaly app ("Pocaly," "we," "our," or "us"), you agree to these Terms of Service. If you do not agree, do not use the app.
2 Eligibility
You must be at least 13 years old to use Pocaly. By creating an account, you represent that you meet this age requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.
3 Your Account
You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@pocaly.app if you believe your account has been compromised.
You may only have one account. Creating multiple accounts to circumvent restrictions is prohibited.
4 What Pocaly Is (and Is Not)
Pocaly is a personal collection management and community catalog tool for K-pop photocards. It is not a marketplace. Pocaly does not facilitate the purchase or sale of physical photocards, does not process payments between users, and has no role in any transaction between users. The trade feature described in Section 9 is strictly a matching and contact tool — all exchanges happen entirely off-platform.
5 Subscriptions
Pocaly offers a free tier and paid subscription tiers (Bias and Ult) that unlock additional features including higher AI scan quotas, additional wishlists, and theming options. Current pricing is displayed in the app.
Subscriptions are billed through the Apple App Store. Apple's payment terms and refund policies apply. We do not handle payment information directly.
You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods.
We may change subscription pricing or feature availability. We will give you reasonable notice of material changes.
During the first year following Pocaly's launch, users who contribute 250 or more approved photocard scans, or a complete group discography with photocard data verified by Pocaly, may qualify for a complimentary Lifetime subscription.
- Lifetime subscriptions are capped at 250 total across all users. Rewards are granted on a first-come-first-served basis and are only available while Lifetime slots remain.
- Contributions must be verified and approved by Pocaly before a reward is granted.
- To claim a reward, contact hello@pocaly.app once your contributions have been verified.
- Pocaly reserves the right to modify or discontinue this program at any time, provided that rewards already granted will be honored.
- The reward has no cash value and is non-transferable.
6 User Content
"User Content" includes photocard images you submit to the community database, your profile information, and any other content you provide to Pocaly.
By submitting User Content, you grant Pocaly a worldwide, non-exclusive, royalty-free license to store, display, and distribute that content within the Pocaly app and community database. You retain ownership of content you created.
By submitting content, you represent that:
- You have the right to submit it (e.g. you photographed the physical item yourself).
- It does not violate any third party's rights.
- It is accurate and not misleading.
You may not submit content that is:
- Obscene, harassing, or hateful.
- Fraudulent or deliberately mislabeled.
- Private information about another person without their consent.
We reserve the right to reject or remove any submitted content at our discretion.
7 Photocard Images and Copyright
Pocaly's database contains fan-submitted photographs of physical photocards. Photocards are copyrighted works of their respective entertainment companies (ATEEZ / KQ Entertainment, Seventeen / Pledis Entertainment, Stray Kids / JYP Entertainment, TXT / Big Hit Music/HYBE). Pocaly operates as a fan reference database in good faith.
If you are a rights holder and believe content in our database infringes your copyright, please submit a notice to hello@pocaly.app with the following information:
- Your name and contact information.
- Identification of the copyrighted work you claim is infringed.
- Identification of the material you claim is infringing, and where it appears in the app.
- A statement that you have a good-faith belief the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights holder.
We will respond promptly and remove infringing content where required.
8 Acceptable Use
You agree not to:
- Use Pocaly for any unlawful purpose.
- Attempt to access another user's account or data.
- Scrape, harvest, or extract data from Pocaly in bulk.
- Reverse-engineer, decompile, or attempt to extract source code from the app.
- Interfere with or disrupt Pocaly's servers or infrastructure.
- Submit false or deliberately inaccurate data to the community database.
- Use the trade matching feature to facilitate commercial resale (trade-only; no selling).
9 Trade Feature
The trade feature allows users to signal that they have photocards available for trade and to find other users seeking those cards. Pocaly's role is limited to displaying this information.
We strongly recommend that you use caution when trading with strangers online and never share personal information beyond a social media handle or link.
10 AI Card Matching
The AI card-matching feature ("Scan") uses a CLIP embedding model (via Replicate) to compare your scanned card image against the database. Results are probabilistic and may be incorrect. Always verify AI match results before logging a card to your collection. Pocaly does not guarantee the accuracy of AI matching.
AI scan quotas reset on the first of each month. Unused scans do not roll over.
11 Disclaimer of Warranties
Pocaly is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses.
12 Limitation of Liability
To the fullest extent permitted by law, Pocaly and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.
13 Termination
We may suspend or terminate your account if you violate these terms, with or without notice. You may delete your account at any time through the app or by emailing hello@pocaly.app. Upon termination, your personal collection data will be deleted per our Privacy Policy. Community-contributed content that has been published may remain.
14 Governing Law
These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of New Hanover, North Carolina, and you consent to personal jurisdiction there.
15 Changes to These Terms
We may update these Terms as the app evolves. We will post the updated Terms at pocaly.app/terms and update the "Last updated" date. Continued use of Pocaly after the effective date constitutes acceptance of the updated Terms.
